Terms of Use

JobDash, LLC ("JobDash," "our," or "we") provides a platform for students to facilitate career goals and job placement, while allowing colleges, universities, and other educational related institutes ("College" or "Colleges") to monitor student progress. These services are provided through a variety of online means, and "you" as the "end-user", by using any of JobDash's services or viewing any of its webpages, hereby agree to these terms of use. Please read these terms in their entirety and do not use JobDash's services if you disagree with these terms of use.

Our Services

Our goal is to provide you with an online platform to assist you in your career goals and job search. Our services allow your College to monitor your progress, assist you with your goals, and obtain important statistical information for accreditation and other reporting purposes. To that end, we collect information you provide and use it to generate reports to be used by Colleges or their affiliates. Our services are provided through the use of proprietary software that we license to each College, and through our website and other embeddable items that provide links to our website or software ("Software").

Account Term

The use of the JobDash website and Software is subject to your College's licensing agreement with JobDash. Colleges generally purchase licenses for students to use the JobDash software for a two year period during which they can monitor and assess student progress. It is JobDash's intent to allow students to use their JobDash account upon the expiration of your College's license. However, JobDash does not guarantee extended use of your account and reserves the right to terminate your account at any time including upon completion of JobDash's agreement with your College. JobDash is not responsible for data or information lost or destroyed upon termination of your account.

Information Provided To College

Information you provide to JobDash or enter into your account will be accessible by your College and may be used by your College for advisory, statistical, or other reporting or evaluation purposes.

Electronic Information

JobDash may use cookie technology to associate certain Internet-related information about you with information about you in its database.

  • (a) Cookies. "Cookies" are a feature on your browser software. If enabled, we may write cookies that may store small amounts of data on your computer about your visit to any of the pages of this Site. We may link the information we store in cookies to any personally identifiable information you submit while on our site. Cookies assist us in tracking which of our features appeal the most to you and what content you may have viewed on past visits. When you visit this site again, cookies can enable us to customize our content according to your preferences. We may use cookies to, among other things: keep track of the number of return visits to this site; accumulate and report aggregate, statistical information on website usage; or deliver specific content to you based on your interests or past viewing history. Your browser preferences can be modified to accept or reject all cookies, or request a notification when a cookie is set. You may read more about cookies at http://cookiecentral.com. In order to use all of the features and functionality of the JobDash website, you need to accept cookies.
  • (b) IP Addresses. JobDash automatically tracks certain information based upon your behavior on the website. We may use this information to do internal research on our users' demographics, interests, and behavior to better understand, protect and serve you and our community. This information may include the URL that you just came from (whether this URL is on the site or not), which URL you next go to (whether this URL is on the site or not), your computer browser information, and your IP address. Your Internet Protocol ("IP") is a unique Internet "address" which is assigned to you by your Internet Service Provider ("ISP"). For local area network ("LAN"), DSL, or cable modem users, an IP address may be permanently assigned to a particular computer. IP addresses are automatically logged by Web servers, collecting information about a user's traffic patterns. While the IP address does not identify an individual by name, it may, with the cooperation of the ISP, be used to locate and identify an individual using the Web. Your IP address can, however, reveal what geographic area you are connecting from, or which ISP you are using. Finally, other websites you visit have IP addresses, and we may collect the IP addresses of those websites and their pages.
  • (c) Computer Profiles. JobDash may also collect and accumulate other anonymous data which will help us understand and analyze the Internet experience of our visitors. For instance, Company may accumulate visitor data relating to referring domain names, the type of browsers used, operating system software, screen resolutions, color capabilities, browser plug-ins, language settings, cookie preferences, search engine keywords and JavaScript enablement.
  • (d) New Technology. The use of technology on the Internet, including cookies and web beacons, is rapidly developing. As a result, JobDash strongly encourages individuals to revisit this policy for any updates regarding its use of new technology. JobDash reserves the right, without providing any notice to you, to implement any new technology that becomes available.

Aggregate Statistics

JobDash may disclose aggregate statistics regarding user behavior as a measure of interest in, and use of, our website and emails to third parties in the form of aggregate data, such as overall patterns or demographic reports that do not describe or identify any individual user.

Service Providers

JobDash may use third parties to help operate our Software and deliver products and services, and may share your personal Information with our service providers and other third parties that provide products or services for the JobDash Software and website or for our business (such as database hosting companies, email service providers, analytics companies, and a third party call center to offer you additional college choices). Unless otherwise stated, these companies do not have any right to use the personal information we provide to them beyond what is necessary for them to assist us.

Complying With Legal Process

Company will use or disclose your personal information in response to subpoenas, court orders, warrants, or legal process, or to otherwise establish or exercise our legal rights or defend against legal claims or in the event you violate or breach an agreement with JobDash. JobDash will use and disclose your personal information if we believe you will harm the property or rights of JobDash, its owners, or those of JobDash's other customers. Finally, we will use or disclose your personal information if we believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of JobDash's acceptable use policy, or as otherwise required by law when responding to subpoenas, court orders and other legal processes.

Electronic Communication

By using the Site and/or the Services, you consent to receiving electronic communications from JobDash. These electronic communications may include information about JobDash's Services and features, as well as other information concerning or related to the Site or Services. These electronic communications are part of your relationship with JobDash. You agree that any notices, agreements, disclosures or other communications that we send you electronically will satisfy any legal communication requirements, including that such communications be in writing.

Foreign Use Of Website

To the extent that you are accessing the website while domiciled outside of the United States, you acknowledge that the Personal Information you are providing Company is collected and stored in the United States and therefore consent to the transfer of information to and storage of the information outside of your domiciled country and in the United States.

Our Obligations To You

We are committed to providing you with quality service and enjoyable experiences. However, we cannot guarantee your career objectives or goals will be met or that you will be successful in finding employment. Our role is to provide the Software to be used as a tool to organize your career search and facilitate collaboration with your College in that process.

Links and Advertisements. As a courtesy to you, JobDash may offer you links to other websites or may display advertisements, some of which may be affiliated with JobDash while others are not. We are not responsible for the contents of any websites created and maintained by others. Visiting any such third-party website pages is at your own risk. JobDash has no control of these third-party websites, nor does it guarantee anything in connection with these websites. Your use of these websites is voluntary, and your reliance on such information should be made only after independent review. References to commercial products or services within any other websites do not constitute or imply an endorsement by JobDash.

Your Obligations

You will not steal or otherwise copy our Software or share this Software with others. You will not place harmful material in any of the Software nor will you attempt to use the Software to distribute harmful material to anyone else. You may not place your own software or other embeddable devices on our Software without our written permission.

As an End-user of our services, you also agree:

  1. not to use our services if you are a minor;
  2. to create your own account and not use a third-party's account;
  3. to comply with all applicable laws, including trademark and copyright laws;
  4. to use our services only for your personal, non-commercial use;
  5. not to attempt to gain unauthorized access to any computer systems from or through our services; and
  6. not to interfere with others as they use our services.

Indemnity. You agree to indemnify and hold JobDash, its parents, subsidiaries and affiliates, agents, officers, directors, or other employees harmless from any claim, demand, or damage (whether direct, indirect, or consequential), including reasonable attorneys' fees, made by anyone in connection with your use of our services, with any alleged infringement of intellectual property or other right of any person or entity relating to our services, your violation of these Terms of Use, and any other acts or omissions relating to our services.

Your Representations

By using our services, you represent to that:

  • all of the information you submit to us is truthful and accurate;
  • you are responsible for the continued accuracy of this information by keeping your information updated; and
  • you and your College are the only persons or organizations who will use your account. Thus, you and your College are responsible for the use of your account and for keeping your account information confidential.
  • JobDash is not liable for any losses you incur as a result of improper use of your account.
  • these Terms of Use are supported by reasonable and valuable consideration, the receipt and adequacy of which you acknowledge. Without limiting the foregoing, you acknowledge that such consideration includes, without limitation, your use of our services.

Modifications

JobDash has the right to modify these Terms of Use at any time or to modify its services at any time without notice to you. Continued use of our services indicates that you have accepted and agree to be bound by the modified terms or services. Modifications will be effective the day they are posted unless a later effective date is indicated. JobDash also has the right to terminate its services at any time.

Disclaimer of Warranties

THE INFORMATION, CONTENT, PRODUCTS, SERVICES, AND MATERIALS AVAILABLE THROUGH OUR SERVICES (WHETHER PROVIDED BY JOBDASH OR OTHERS), INCLUDING WITHOUT LIMITATION, PRODUCT OR SERVICE ORDERS AND WEBSITE CONTENT, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBDASH DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NONINFRINGEMENT, FREEDOM FROM COMPUTER VIRUS, AND IMPLIED WARRANTIES ARISING FROM THE COURSE OF DEALING OR COURSE OF PERFORMANCE.

Limitation of Liability

IN NO EVENT SHALL JOBDASH BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OR DAMAGES WHATSOEVER (EVEN IF JOBDASH HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), WHETHER IN AN ACTION UNDER CONTRACT, NEGLIGENCE, OR ANY OTHER THEORY, IN ANY MANNER ARISING OUT OF OR IN CONNECTION WITH THE USE, INABILITY TO USE, PERFORMANCE OF, OR SERVICES PROVIDED ON OR THROUGH OUR SERVICES OR SOFTWARE.

JOBDASH ASSUMES NO RESPONSIBILITY AND SHALL NOT BE LIABLE FOR ANY DAMAGES TO, OR VIRUSES THAT MAY INFECT, YOUR COMPUTER EQUIPMENT OR OTHER PROPERTY ON ACCOUNT OF YOUR ACCESS TO, USE OF, BROWSING OF, OR DOWNLOADING OF ANY MATERIAL FROM OR THROUGH OUR SERVICES OR SOFTWARE. JOBDASH ASSUMES NO RESPONSIBILITY OR LIABILITY IN ANY MANNER ARISING OUT OF OR IN CONNECTION WITH ANY INFORMATION, CONTENT, PRODUCTS, SERVICES, OR MATERIAL AVAILABLE ON OR THROUGH THE SITES, AS WELL AS ANY THIRD PARTY WEBSITE PAGES OR ADDITIONAL WEBSITES LINKED TO THIS SITE, FOR ANY ERROR, DEFAMATION, LIBEL, SLANDER, OMISSION, FALSEHOOD, OBSCENITY, PORNOGRAPHY, PROFANITY, DANGER, INACCURACY CONTAINED THEREIN OR HARM TO PERSON OR PROPERTY CAUSED THEREBY. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

IN NO EVENT SHALL JOBDASH'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO, NEGLIGENCE) OR OTHERWISE, EXCEED (A) THE AMOUNT PAID BY YOU TO JOBDASH, IF ANY, OR (B) $100 (WHICHEVER IS LESS).

YOU AND JOBDASH AGREE THAT THE WARRANTY DISCLAIMERS AND LIMITATIONS OF LIABILITY IN THESE TERMS OF USE ARE MATERIAL, BARGAINED-FOR BASES OF THIS AGREEMENT, AND THAT THEY HAVE BEEN TAKEN INTO ACCOUNT IN DETERMINING THE CONSIDERATION TO BE GIVEN BY EACH PARTY UNDER THIS AGREEMENT AND IN THE DECISION BY EACH PARTY TO ENTER INTO THIS AGREEMENT. YOU AND JOBDASH AGREE THAT THE WARRANTY DISCLAIMERS AND LIMITATIONS OF LIABILITY IN THESE TERMS OF USE ARE FAIR AND REASONABLE.

IF YOU ARE DISSATISFIED WITH OUR SERVICES OR DO NOT AGREE TO ANY PROVISIONS OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING OUR SERVICES, EXCEPT AS MAY BE PROVIDED FOR IN THESE TERMS OF USE.

Legal Items

Applicable Law. These Terms of Use shall be governed by and construed in accordance with the laws of the State of Utah, despite any conflict of law provisions to the contrary.

Disputes. By using our services, you consent to resolve any disputes associated with these Terms of Use, with us, or with our services in a Utah State Court in Salt Lake City, Salt Lake County, Utah. If there is a dispute between you and your College, these Terms of Use do not obligate us to be involved in any way to help resolve that dispute, and nothing contained herein shall be construed as creating a liability on our part for an act or omission of a College.

Intellectual Property Rights. JobDash has intellectual property rights in its services and associated content placed on its website. These include, but are not limited to, trademarks and copyrights. You are granted an individual, personal, non-exclusive, non-transferable license to access the content on this Site and to print copies of any content only for your personal use. Except as expressly provided above, all rights are reserved. Among other things, except to the extent required for the limited purpose of reviewing material on our Site, electronic reproduction, adaptation, distribution, performance or display is prohibited. Commercial use of any content is prohibited.

Entire Agreement. These Terms of Use constitute the entire agreement between you and JobDash, superseding all prior agreements regarding our services.

No Waiver. The failure of JobDash to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of JobDash's said right or provision.

Force Majeure. Neither party hereto shall be deemed to be in default of any provision of the Terms of Use or for failure in performance resulting from acts or events beyond the reasonable control of such party and arising without its fault or negligence, including, but not be limited to, acts of God, civil or military authority, interruption of electric or telecommunication services, civil disturbances, acts of war or terrorists, strikes, fires, floods or other catastrophes.

Headings & Construction. The section titles, captions, and headings contained in this Agreement are inserted only as a matter of convenience and for reference, and shall in no way be construed to define, limit, or extend the scope of this Agreement or the effect of any of its provisions. The language in these Terms of Use shall be interpreted in accordance with its fair meaning and shall not be strictly interpreted for or against either party.

Severability. If any provision or part of a provision of the Terms of Use is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from the Terms of Use and does not affect the validity and enforceability of any remaining provisions.

California User Consumer Rights.
